In this paper I examine the shortcomings of both capacitarian and attributionist accounts of responsibility by considering cases of mental illness and neurodivergence. I argue that the impacts of mental illness on agency are often more pervasive than is recognised in capacitarian accounts. In particular I show that the epistemic condition and the control condition relied on in such accounts cannot be neatly separated. Attributionist accounts are better placed to recognise the identity constituting aspects of mental health and neurodivergent conditions but in tying responsibility to attributability they also leave people open to unfair blame. I close by briefly considering alternative approaches.
